About this deal

This is a complex legislative picture and is not easy to navigate – we intend to improve and evolve this baseline in future as part of our agricultural transition outside of the European Union (EU). However, like education, farming is an occupation, not trade or commerce. If foodstuffs are considered synonymous with agriculture, then all the powers of states in respect of agriculture, listed so elaborately in the Constitution, shall become redundant. After that defeat, groups like the National Pork Producers Council have turned their support to the Eats Act, which, if passed, would also invalidate Proposition 12. NPPC supports finding a legislative solution, like the Eats Act, to Proposition 12 to prevent state and local governments from interfering with the production of agricultural products in other states,” the NPPC said in a public statement. This plan marks an historic shift in the way we manage our land, setting us on course toward the production of sustainable food at the same time as rising to the urgent task if halting and reversing the decline of Nature. In Punjab and Haryana, the epicentre of the protests, the market fee, rural development fee, and arhatiya’s commission are 3%, 3%, and 2.5%; and 2%, 2%, and 2.5% respectively. These are big sources of state revenue — with states not permitted to levy market fee/cess outside APMC areas under the new laws, Punjab and Haryana could lose an estimated Rs 3,500 crore and Rs 1,600 crore each year respectively. What is the question over the constitutionality of these laws? We heard that even when the relevant piece of legislation was found, the wording made it difficult to work out what action needed to be taken to comply. All of this legislation applies to agricultural activity, and collectively constitutes what is known as the ‘regulatory baseline for agriculture’. Over the past few months, we set up a series of video calls with those who volunteered. In this post, I’ll share a summary of what they told us and our work to improve things. What we heard

A statutory instrument (SI) is expected to be laid in Parliament this week to implement these simplifications ready for next year’s scheme. This SI will also allow for improvements to cross compliance, such as the greater use of warning letters instead of default financial penalties and better inspection targeting.
